Is betting gambling legal in India? Mostly no: gambling is a state subject governed by the Public Gambling Act, 1867 and state laws, with exceptions for licensed casinos in Goa, Daman and Sikkim, horse racing and state lotteries, while online real-money games, including sports betting, poker and rummy, have been banned nationwide since the Promotion and Regulation of Online Gaming Act, 2025 came into force. This is general information, not legal advice.

The Short Answer
Gambling is illegal by default, with narrow permissions.
- One guide says gambling in India remains illegal, primarily under the Public Gambling Act, 1867, a colonial-era law
- It is a state subject, with states free to license or ban, which produces a patchwork
- Most forms of betting and gambling, including cricket betting, are prohibited, according to one guide, and online cricket betting was described in 2025 as a legal grey area before the new Act
The Old Framework
The 1867 law and state acts did most of the work.
- The Public Gambling Act, 1867 is a central law that prohibits operating or managing public gambling establishments
- States adopted it or passed their own versions, under Entry 34 of List II, the state list
- Courts developed a skill-versus-chance distinction, with games predominantly of skill treated as outside gambling laws
- In 2022 the government announced plans for a new gaming bill to replace the 1867 Act
What Is Legal
A few categories remain permitted.
- Casinos: licensed physical casinos operate in Goa and Sikkim, and Daman, under their state frameworks
- Horse racing: in K.R. Lakshmanan (1996), the Supreme Court recognised horse racing as a game of skill. Betting on it is legal in states such as Maharashtra, Telangana and West Bengal under regulated conditions
- Lotteries: legal in states that permit them
- Gambling in other states is generally prohibited, and sports betting beyond horse racing is largely viewed as illegal
The Online Gaming Act
The big change came in 2025 and took effect in 2026.
- The Promotion and Regulation of Online Gaming Bill passed the Lok Sabha on 20 August 2025 and the Rajya Sabha on 21 August, and received the President’s assent on 22 August 2025
- Several sources say the Act and its Rules came into force on 1 May 2026, with draft Rules released by MeitY on 12 October 2025
- It prohibits any online game played by depositing money or stakes in expectation of a monetary win, whether based on skill or chance
- Section 5 prohibits offering, aiding, abetting or inducing the offering of an online money game or service
- That bans online casinos, sports betting, poker, rummy and fantasy contests for money, according to one 2026 guide
- Even Goa can’t permit online money gaming, since the national ban sets a floor
- Esports and online social games without monetary stakes are permitted and regulated
The Supreme Court in 2026
Courts have backed the bans.
- On 27 May 2026, the Supreme Court upheld the Tamil Nadu and Karnataka laws banning online games played for money and set aside High Court rulings that had struck them down, according to two sources
- It held that states can regulate or prohibit betting and wagering involving money even where the underlying game is one of skill
- That removes the old “skill game” defence for online money games
- The constitutional validity of the central Act is still being challenged before the Supreme Court, and challenges were transferred there in 2025
Cricket and Sports Betting
The position is clear in principle.
- Sports betting other than horse racing is considered illegal because outcomes depend primarily on chance, according to one legal analysis
- Sikkim once licensed online sports betting, but a 2026 guide says that’s now banned under the central override
- Offshore betting sites operate in a legal grey area for users, but the central Act targets platforms offering online money games, and I found no source here describing penalties for players
Where Sources Differ
Details vary.
- The date the Act took effect, since some describe the 2025 assent and others 1 May 2026
- Whether certain states’ rules, such as Sikkim’s, survive the central Act
- Penalty figures, which these sources don’t give
- Check the Act, the Rules and your state’s gambling law for specifics
Practical Risks
Legality isn’t the only concern.
- Unlicensed betting apps offer no legal recourse if they refuse to pay
- Payment fraud and account freezing are common, according to general reporting, though I didn’t find figures in these sources
- Advertising or promoting banned games can create liability, and the Act’s Section 5 covers inducing others
- If gambling is causing harm, seek support early
FAQs
Q1. Is betting legal in India?
A. Betting and gambling are generally restricted in India, but the legal position depends on the activity and applicable central and state laws. Certain regulated activities, such as authorised lotteries, horse racing, and licensed casino gaming in permitted jurisdictions, may be treated differently.
Q2. Is online betting legal in India in 2026?
A. Online betting and other real-money gaming activities are subject to significant legal restrictions in India. The applicable rules can depend on central legislation, state gambling laws, the nature of the game, and subsequent court decisions.
Q3. Is cricket betting legal?
A. Cricket betting is generally not legally permitted as ordinary wagering in India. It should not be confused with specifically regulated activities such as authorised horse-race betting in jurisdictions where it is permitted.
Q4. Are fantasy sports and rummy legal for real money?
A. The legal treatment of real-money fantasy sports and rummy has evolved through legislation and court decisions, and restrictions can apply at both central and state levels. Their legality should therefore be assessed under the latest applicable law rather than relying only on older court rulings that classified particular formats as games of skill.
